1) Scope
1.1 These General Terms and Conditions (hereinafter “GTC”) of [Your Business Name] (hereinafter “Seller”) apply to all contracts concluded between a consumer or entrepreneur (hereinafter “Customer”) and the Seller relating to all goods and services presented in the Seller's online shop. The inclusion of the Customer’s own terms and conditions is hereby rejected unless otherwise agreed.
1.2 These GTC also apply to the delivery of vouchers unless otherwise explicitly agreed.
1.3 A consumer is any natural person who enters into a legal transaction for purposes which are predominantly outside their trade, business, or profession.
1.4 An entrepreneur is any natural or legal person, or a partnership with legal capacity, who acts in the course of their commercial or independent professional activity when entering into a legal transaction.
2) Conclusion of Contract
2.1 The product descriptions in the Seller’s online shop do not constitute binding offers by the Seller but serve to submit a binding offer by the Customer.
2.2 The Customer can submit the offer via the Seller's online order form. After placing selected goods in the virtual shopping cart and going through the electronic ordering process, the Customer makes a legally binding offer by clicking the button that finalizes the order.
2.3 The Seller may accept the Customer's offer within five days:
-
by sending a written or electronic order confirmation, or
-
by delivering the goods, or
-
by requesting payment.
If multiple options apply, the contract is concluded at the moment the first of these events occurs.
2.4 The text of the contract will be stored by the Seller and sent to the Customer in text form (e.g., email) after the conclusion of the contract.
2.5 The contract is concluded in English. Other languages may be made available depending on the region of sale.
2.6 The processing of the order and communication shall take place by email. The Customer must ensure that the provided email address is correct and that communication from the Seller or third parties acting on its behalf can be received.
3) Right of Withdrawal
3.1 Consumers are entitled to a statutory right of withdrawal.
3.2 Detailed information on the right of withdrawal can be found in the Seller’s Cancellation Policy.
3.3 Voluntary 30-Day Return Policy: In addition to the statutory right of withdrawal, the Seller offers a voluntary 30-day return period for unused items in original condition. This right does not affect the statutory right of withdrawal.
4) Prices and Payment Terms
4.1 All prices are inclusive of applicable statutory VAT. Any additional delivery or shipping costs will be disclosed separately.
4.2 For international deliveries outside the European Union, additional costs (e.g., customs duties, taxes) may apply, which are the Customer’s responsibility.
4.3 The available payment methods are shown during the order process and may include PayPal, Stripe, credit card, Klarna, or other providers.
4.4 If advance payment by bank transfer is selected, the payment is due immediately after the conclusion of the contract unless otherwise agreed.
5) Delivery and Shipping Conditions
5.1 The Seller offers delivery to the countries specified in the shop. Unless otherwise agreed, delivery shall be made to the address provided by the Customer.
5.2 All products are shipped directly from the Seller’s logistics partners in China. The standard estimated delivery time to the European Union is 8 to 14 business days after dispatch. Processing time prior to dispatch is generally 1–3 business days.
5.3 In the event of delivery failure due to the Customer's fault (e.g., incorrect address), the Customer may bear the resulting shipping costs unless the Customer has validly exercised their right of withdrawal.
5.4 The risk of accidental loss passes to the Customer when the goods are handed over to a transport carrier.
5.5 Self-collection is not possible due to logistical constraints.
6) Retention of Title
The goods remain the property of the Seller until full payment is received.
7) Liability for Defects (Warranty)
7.1 The statutory rights to liability for defects shall apply.
7.2 If the Customer is an entrepreneur:
-
The Seller has the right to choose the type of subsequent performance.
-
The limitation period for claims based on defects in new goods is one year from the date of delivery.
-
Rights and claims based on defects in used goods are excluded.
-
The limitation does not restart upon replacement within the warranty period.
7.3 The above limitations do not apply to claims for damages, fraudulent concealment of defects, or in cases of liability for digital updates or goods used for construction purposes.
8) Redemption of Promotional Vouchers
8.1 Promotional vouchers issued for free and valid for a specific period can only be redeemed in the online shop and only within the specified validity.
8.2 Restrictions on product categories or minimum purchase values may apply.
8.3 Promotional vouchers must be used before completing the order. They cannot be applied retrospectively.
8.4 Only one voucher per order may be used.
8.5 No cash refund or interest will be paid on any remaining voucher balance.
9) Redemption of Gift Vouchers
9.1 Gift vouchers purchased via the online shop can be redeemed only there.
9.2 Gift vouchers are valid for three years from the end of the year in which they were purchased.
9.3 They may not be used to purchase further gift vouchers.
9.4 Gift vouchers are transferable and may be used by anyone possessing them, unless misuse is suspected.
10) Applicable Law
The law of the Seller’s registered country of incorporation applies, excluding the UN Convention on the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of mandatory protections granted by the laws of their country of residence.
11) Place of Jurisdiction
If the Customer is a merchant, legal entity, or has no general place of jurisdiction within the EU, the place of jurisdiction shall be the Seller's registered business location. The Seller is also entitled to bring legal action at the Customer's place of residence or business.
12) Alternative Dispute Resolution
12.1 The EU Commission provides a platform for online dispute resolution at: https://ec.europa.eu/consumers/odr
This platform serves as a contact point for out-of-court settlement of disputes from online sales contracts.
12.2 The Seller is not obliged and does not agree to participate in dispute settlement proceedings before a consumer arbitration board.
